Terms of Service

1. Acceptance of Terms

By accessing or using Mirrorfy ("the App," "our App," or "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and 杭州罐子猫科技有限公司 (Hangzhou Guanzimao Technology Co., Ltd.) ("we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use Mirrorfy. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• If you are between 13 and 18, you have obtained parental or guardian consent
• You will provide accurate and truthful information
• You will comply with all applicable laws and regulations

3. Description of Service

Mirrorfy is an AI-powered video journaling application that provides:

• Video & Audio Journaling: Tools to record your thoughts and feelings
• AI Character Companions: Thoughtful AI friends who listen and respond to your entries
• Memory Gacha Machine: A feature that surfaces insights from your past entries
• Friend System: The ability to build relationships with AI characters
• Premium Features: Enhanced capabilities through subscription

4. User Accounts

4.1 Account Creation

To use Mirrorfy, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for an extended period
• We are required to do so by law

5. Subscription and Payment Terms

5.1 Mirrorfy Premium

Mirrorfy offers premium subscription plans with enhanced features. Subscription details:

• Billing: Subscriptions are billed through Apple's App Store
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Price Changes: We may adjust pricing with 30 days notice to existing subscribers
• No Refunds: Payments are non-refundable except as required by law or at our sole discretion

5.2 Free Trial

We may offer free trials for premium features. If you do not cancel before the trial ends, you will be automatically charged for a subscription. Trial eligibility may be limited to new users or subject to other restrictions.

5.3 Cancellation

To cancel your subscription:

1. Open Settings on your iOS device
2. Tap your name → Subscriptions
3. Select Mirrorfy
4. Tap "Cancel Subscription"

You will retain access to premium features until the end of your current billing period.

6. User Content and Ownership

6.1 Your Content

You retain all ownership rights to the content you create in Mirrorfy, including:

• Journal entries (text, audio, video)
• Personal reflections and thoughts
• Any other content you submit

6.2 License to Us

By submitting content to Mirrorfy, you grant us a limited, non-exclusive license to:

• Store and process your content to provide the Service
• Use AI technology to generate character responses
• Create the Memory Gacha Machine insights
• Make backups for security and reliability

This license is solely for operating the Service and does NOT allow us to share your personal journal entries with third parties for their own purposes.

6.3 Content Guidelines

While Mirrorfy is a private space for your thoughts, you agree NOT to use the Service to:

• Upload content that is illegal, harmful, or violates others' rights
• Harass, threaten, or abuse others (including AI characters in extreme cases)
• Share content that infringes intellectual property rights
• Attempt to exploit, harm, or endanger minors
• Upload malware, viruses, or malicious code
• Attempt to reverse engineer or hack the Service

7. AI Technology and Limitations

7.1 AI Character Behavior

Our AI characters are powered by advanced machine learning models. You acknowledge that:

• AI responses are generated by algorithms and may contain errors
• AI characters are not sentient and do not have genuine emotions or consciousness
• AI responses should not be considered professional advice of any kind
• We continuously work to improve AI quality but cannot guarantee perfection

7.2 No Professional Advice

Mirrorfy does NOT provide:

• Medical advice or diagnosis
• Mental health treatment or therapy
• Legal advice
• Financial advice
• Any other professional services

Always consult qualified professionals for serious health, legal, or financial matters.

8. Prohibited Uses

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Remove or modify any copyright, trademark, or proprietary notices
• Impersonate any person or entity
• Collect or harvest personal information from other users (not applicable to single-user journal)
• Use the Service to develop competing products or services

9. Intellectual Property Rights

9.1 Our Intellectual Property

Mirrorfy and all related content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes:

• The Mirrorfy app and software code
• AI character personalities, names, and designs
• Graphics, logos, and visual design
• The "Mirrorfy" name and brand

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not include any right to:

• Resell or commercialize the Service
• Modify or create derivative works
• Download (other than page caching) or copy any portion of the Service
• Use the Service for any commercial purpose

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we protect your data.

11. Disclaimers and Limitations of Liability

11.1 Service Provided "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy or reliability of AI-generated content

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Any damages arising from your use or inability to use the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

11.3 Emergency Situations

Mirrorfy is not designed for emergencies. If you are experiencing a mental health crisis or emergency:

• United States: Call 988 (Suicide & Crisis Lifeline) or text "HELLO" to 741741 (Crisis Text Line)
• International: Contact your local emergency services or crisis hotline
• Life-threatening emergencies: Call your local emergency number (911 in the US)

12. Indemnification

You agree to indemnify, defend, and hold harmless Mirrorfy, 杭州罐子猫科技有限公司, and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content uploaded to the Service

13. Modifications to Service and Terms

13.1 Service Changes

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Add or remove features
• Change AI character personalities or behaviors
• Impose limits on certain features or restrict access

We will provide reasonable notice for material changes that negatively impact your experience.

13.2 Terms Updates

We may update these Terms from time to time. If we make material changes, we will notify you by:

• Posting a notice in the App
• Sending an email to your registered email address
• Requiring you to accept the new Terms before continuing to use the Service

Your continued use after changes take effect constitutes acceptance of the new Terms.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of the People's Republic of China, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will work in good faith to reach a resolution within 60 days.

14.3 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. You waive your right to a jury trial or to participate in a class action lawsuit.

14.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or to enforce these Terms.

15. Severability and Waiver

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mirrorfy regarding the Service and supersede all prior agreements and understandings.
